Sean Charles Dunn threw a sandwich at a U.S. Customs and Border Protection agent as an act of protest against President Trump's law-enforcement surge.

Dunn's defense attorney, Julia Gatto, argued that the sandwich throw was a harmless gesture at the end of Dunn exercising his right to speak out, and that he is overwhelmingly not guilty.

CBP Agent Gregory Lairmore testified that the sandwich exploded when it struck his chest, and he could smell the onions and mustard.

The government charged Dunn with a misdemeanor assault after a grand jury refused to indict him on a felony assault count.

Dunn's lawyers argued that he was impermissibly targeted for his political speech, citing posts by Attorney General Pam Bondi and the White House, and urged the judge to dismiss the case for vindictive and selective prosecution.
