White House Says Furloughed Federal Workers Aren't Owed Back Pay

A draft White House memo argues that furloughed federal workers are not entitled to back pay after the government shutdown lifts, according to White House press secretary Karoline Leavitt.

The memo contradicts the Office of Personnel Management's guidance from September, which said federal workers would receive retroactive pay after the shutdown ends.

The 2019 Government Employee Fair Treatment Act mandates that all federal employees, furloughed or working without pay, must receive back pay after a shutdown.

The White House believes that the law does not automatically cover all furloughed workers due to a clause requiring Congress to appropriate back pay once a shutdown ends.

Pressure is mounting on Democrats to vote for a GOP-supported continuing resolution to fund the government, with the White House using the memo to increase pressure on the Senate to pass the bill.
