Area Restaurants Sue Governor & Dr. Acton Over "Vagueness" Of Rules

(Cleveland) - The owners of eight bars and restaurants have filed suit against Ohio Governor Mike DeWine and State Department of Health Director Amy Acton, for imposing what are being called "vague and unconstitutional" rules under which bars and restaurants must operate, post-pandemic.

The establishments bringing the suit are:

  • Diamondback Bar, Eastlake
  • Harry Buffalo, East 4th Street location, Cleveland
  • islander Bar & Grill, Middleburg Heights
  • Grayton Road Tavern, Cleveland
  • Park Street Cantina, Columbus
  • Town Hall, Cleveland
  • Bar 30, Parma
  • Frank & Tony's, Willoughby

Tom Connick, who is representing the restaurants and bars in the suit, says one example of how the guidelines are vague has to do with making sure that customers stay in their seats. He says it's not defined as to how long they can get up to go to the batrhoom.

Connick says he's aware that there have been settlement in similar cases brought by other businesses, mainly having to do with when they were allowed to open. He has not heard from the state about whether they are willing to settle in this case.
