A judge in Franklin County has declined a recommendation to postpone Tuesday's primary election vote in the State of Ohio.
Judge Richard Frye has overridden the recommendation by Ohio Governor Mike DeWine and Ohio Secretary of State Frank LaRose to delay the 2020 primary vote on June 2 while absentee voting continued statewide until that date.
State leaders are now appealing Judge Frye's ruling. Governor DeWine has no authority to delay an election so a lawsuit had to be filed Monday in Franklin County.
The suit was filed by two women who are both over the age of 65 and considered 'vulnerable' to factors posed by the coronavirus.
