Pregnant Inmate Seeks Release On Grounds That Baby Is Innocent

A pregnant inmate in Florida is fighting to get released on the grounds that her unborn child is innocent and doesn't deserve to be locked up.

Natalia Harrell, 24, is facing a charge of second-degree murder for the July 2022 murder of Gladys Borcela. She claims the only reason she killed Borcela is she was "in fear of her life and the life of her unborn child," according to a police statement. And now she's using the baby in an attempt to get herself out of prison, having a lawyer file a write of habeas corpus on behalf of the baby. It reads, "The unborn child has not committed any crime, nor has the State of Florida, the respondents or Miami Dade State Attorney put forward any allegations that the unborn child committed a criminal offense. Yet, respondents continue to incarcerate unborn child in such deplorable conditions."

In response to the filing, Miami-Dade Corrections has released a statement that reads, "We are conducting a full review of the health services offered and received to ensure that all pre-natal care being provided in our custody is appropriate."
