Hunter Biden files to dismiss indictment on gun charges

Hunter Bidens attorneys filed a motion on Monday afternoon in a Delaware Federal Court in an effort to dismiss the indictment against him over gun charges and claim that it 'violates' the failed plea agreement.

Special Counsel David Weiss charged Hunter with making a false statement in the purchase of a firearm, making a false statement related to information required to be kept by a federal firearms licensed dealer and one count of possession of a firearm by a person who is unlawful or addicted to a controlled substance.

His attorney alluded that the defense planned to file a motion to dismiss due to a diversion agreement on the gun charges, and thought that it was still in effect. It was part of the original plea deal that fell through in July.

Abbe David Lowell, Bidens attorney went on to say, "The Court should require the prosecution to honor its agreement and dismiss the Indictment." Hunter pleaded not guilty to the charges during a court appearance in October.
