Legal Challenge Filed to Ohio's "Heartbeat Bill"

COLUMBUS, Ohio (WTVN)--Just days after the US Supreme Court overturned Roe v Wade, and an injunction against Ohio's "Heartbeat Bill" was lifted, activists have filed a legal motion to have that bill overturned.

The ACLU of Ohio, Planned Parenthood, and abortion clinics across the state were part of the legal action filed Wednesday with the Ohio Supreme Court. Their argument is that Senate bill 23 is unconstitutional.

The activists cite the Ohio constitution, claiming the law discriminates against women. Ohio Attorney General Dave Yost requested that an injunction against Senate Bill 23, imposed in 2019, be lifted. That request was granted the same day the US Supreme Court decision was rendered.

Senate Bill 23, known to supporters and activists alike as the "heartbeat bill", bans an abortion when the first fetal heartbeat is detected. That can happen as little as six weeks into a pregnancy.
