Kevin Dugar (the brother who did the time in prison) was convicted of a gang-related murder in Chicago.
His twin brother, Karl, confessed to the murder 10 years later in a letter he wrote to Kevin.
A judge denied a retrial request questioning the credibility of the confession. The decision was later reversed by the Court of Appeals.
Prosecutors argued Karl only came forward after he was convicted of another crime and serving a 99 year prison sentence.
Kevin will be released to a residential transitional facility for 90 days as a condition of his release.
