AZ Supreme Court Rules State Can Enforce Old Anti-Abortion Law

The Arizona Supreme Court on Tuesday ruled that It’s OK for the state’s government to enforce an 1864 law that makes almost all abortions a criminal act.

The long-dormant law includes only one exception: When the mother’s life is at stake. Anyone who helps a woman have an abortion under any other circumstances “shall be punished by imprisonment in the state prison for not less than two years nor more than five years," according to Arizona Revised Statute 13-3603.

Although the court ruled the law can start being enforced in 14 days, whether that actually happens remains to be seen. Attorney General Kris Mayes has said as long as she’s in office, “no woman or doctor will be prosecuted under this draconian law in this state.
